Banking Law

We have an active and robust banking law practice. We represent banks and financial institutions in their relationships with their borrowers, including negotiation and documenting complex commercial loan transactions. When loans fall into default, we conduct foreclosures, replevins, and other collection activities on behalf of the lender. Our lawyers have represented parties in cases before the Supreme Court of Florida which established the unconstitutionality of a portion of the Florida distress for rent statute, and the constitutionality of the Florida replevin statute. Our lawyers were deeply involved in assisting financial institutions in working through massive loan defaults in Florida during the “Great Recession,” and handled literally hundreds of loan enforcement actions to collect on defaulted loans. Fishback Dominick lawyers have over 60 years of collective experience representing banks and other financial institutions in these type of matters.
