Partner Dan Langley Gives Presentation on Municipal Regulation of Internet Cafes (Electronic Sweepstakes)

July 19, 2012 – During the 2012 Florida Municipal Attorneys Association (FMAA) seminar, Fishback Dominick partner, Dan Langley made a presentation to city attorneys from throughout the State of Florida titled, “Municipal Regulation of Internet Cafes (Electronic Sweepstakes).”  The presentation provided an update on pending litigation relating to internet cafe/electronic sweepstakes establishments, gave an overview of various measures local governments are taking in response to the proliferation of electronic sweepstakes operations, and clarified Florida law with respect to these establishments, and the misperception that a loophole exists in the law allowing these establishments to operate.

Mr. Langley has extensive experience dealing with internet cafe/electronic sweepstakes regulation and litigation.  Mr. Langley successfully defended the City of Longwood from an inverse condemnation, declaratory judgment, and injunctive relief lawsuit brought in February 2010, by an affiliate of internet cafe/electronic sweepstakes operator Allied Veterans of the World, Inc.   Mr. Langley drafted for the City of Winter Garden one of Florida’s first municipal ordinances (adopted January 11, 2011), prohibiting the use, play, operation, or possession of electronic sweepstakes devices (a/k/a commercial gaming devices) within the city’s boundaries.  In the Spring of 2012, the City of Port Orange retained Mr. Langley to assist as Special Counsel in the prosecution of code enforcement violations under the City’s Simulated Gambling Ordinance.  Mr. Langley often receives correspondence from city attorneys from around the State of Florida requesting information and guidance on internet cafe/electronic sweepstakes regulation and litigation.
